OSMANLI DEVLETİNDE KADINA ŞİDDET VAKALARI VE KADIN CİNAYETLERİ

Abstract

Bu çalışmada; Osmanlı Devleti'nde kadına yönelik şiddet vakaları ve kadın cinayetleri arşiv belgelerinin ışığında ele alınmış şer'iye sicilleri, mahkeme tutanakları, kısas ve kalebent defterlerine yansıyan hükümler incelenerek değerlendirilmiştir. Son yıllarda etkileri ve sonuçları ile sosyal ve psikolojik bir çöküntü haline gelen "Kadına Yönelik Şiddet Vakaları ve Kadın Cinayetleri" olgusu tarihsel planda analiz edilerek şiddete maruz kalan veya cinayete kurban giden kadınlara ilişkin davaların Osmanlı hukuk sisteminde nasıl tatbik edildiği ve suçluların ne tür cezalara çarptırıldığı incelenmiştir. Osmanlı Hukukundaki mevcut yasaların şiddet mağduru kadınları ne ölçüde koruyabildiği sorgulanmıştır.

In this study; cases of violence against women and femicides in the Ottoman Empire were handled in the light of archival documents. The provisions reflected in the sharia registers, court records, qisas and kalabent books were examined and evaluated. The phenomenon of "Violence Against Women and Femicides", which has become a social and psychological depression with its effects and consequences in recent years, has been analyzed in the historical context.It has been examined how the cases regarding women who were subjected to violence or murdered were applied in the Ottoman legal system and what kind of punishments the criminals were sentenced to. It has been questioned to what extent the existing laws in Ottoman Law can protect women who are victims of violence.
