Abstract

Bu çalışmada, muasır bir problem olan estetik operasyonlara dair hükümler mukayeseli olarak inceleme konusu yapılmıştır. Çalışmada meşhur dört fıkıh mezhebi çerçevesinde İslam hukukunun bakış açısı ile günümüzdeki bazı Arap ve Batı ülkelerindeki kanuni düzenlemeler mukayeseli olarak ele almıştır. Çalışmamız üç bölüm halinde ele alınmıştır: Birinci bölümde öncelikle güzellik ameliyatlarının tarihi gelişimi ve günümüzde yaygınlaşmasının sebepleri üzerinde durulmuş, sonra ise İslam hukukçularının ve doktorların konuya dair terimleri açıklanmıştır. İkinci bölümde İslam hukukunun konuya bakışı ele alınmıştır. Burada İslam hukukçularının genel olarak tıbbi ameliyatlarla özel olarak ise güzellik ameliyatları ile ilgili görüşleri delilleri ile beraber incelenmiştir. Üçüncü bölümde ise güzellik ameliyatlarına dair kanuni düzenlemeler üzerinde durulmuştur. Bu bölümde öncelikle genel olarak tıbbi ameliyatın meşruiyet temelini teşkil eden nazariyelerden söz edilmiş daha sonra ise bazı çağdaş devletlerde bu konu ile ilgili kanuni düzenlemelere dikkat çekilmiştir. Ayrıca güzellik ameliyatlarında uyulması gereken ilkeler, görevler ve şartlar tespit edilmiştir. Çalışmamız araştırmanın sonuçları ve teklifleri ile son bulmaktadır. This research is about the provisions of beautician surgery, which is a contemporary medical case, from the perspective of Islamic rules, and based on the four famous sects of the legal jurisprudence of some contemporary Arab and foreign countries. The nature of this research required to be divided into three chapters: In the first chapter, we mentioned the historical development of beautician surgery and the reasons behind its propagation nowadays, and also the terms that are related to the title of research to the scientists of religion, laws and medicine. In the second chapter, we have explained the stance of Islamic religion by mentioning the opinions of the jurists and their proofs of the medical in general and the beautician surgeries in particular, and then we have analyzed these 0pinions within an examples of some beautician surgeries and their types. And in the third chapter, we talked about the legal provisions for beautician surgeries, after we have mentioned about the legal basis of the medical in general, we entered into the stance of legislation in some contemporary countries and did our research about the obligations, duties and conditions related to beautician surgeries.
