EKONOMİK SUÇLARA VERİLEN CEZALARIN ALGISI ÜZERİNE BİR ARAŞTIRMA

Abstract

Geçmişten günümüze kadar gelen suç olgusu, tüm insan topluluklarında var olmuş ve gelecekte de varlığını sürdürecektir. İnsan topluluklarıyla yaşayan bu olgu, son dönemlerde iktisat biliminin de ilgi alanına girerek, ekonomik boyutuyla incelenmeye başlanmıştır. Bu çalışmada öncelikle suç kavramı incelenmiştir. Daha sonrasında ekonomik suç kavramına değinilmiş olup bazı ekonomik suç türleri açıklanmıştır. Ekonomik suç kavramı açıklanırken ilk başta ekonomik suç tanımı yapılmış olup daha sonrasında ekonomik suç tarihi; dünya geneli, Osmanlı Devleti ve Türkiye Cumhuriyeti boyutları çerçevesinde ele alınmıştır. Suçun ekonomik modellerine ve suçun ekonomik modellerinde suç piyasasına değinilerek, suç ve ekonomi arasındaki ilişki açıklanmıştır. Bazı ekonomik suç türlerinin tanımları yapılarak TCK'daki tanımlarına yer verilmiştir. Son kısımda ise ekonomik suçlara verilen cezaların algısının değerlendirilmesi için Elazığ Adliyesi ve Elazığ Adliyesine bağlı mülhakat adliyelerde görev yapan 192 kişiyle yapılan anket çalışmasının sonucunda elde edilen veriler incelenmiştir. Uygulanan anket çalışması sonucunda ekonomik suçlarla mücadelenin geliştirilmesi, eksikliklerin giderilmesi, suç oranlarının azaltılması yönünde çalışmalar yapılmasının toplum açısından önem arz ettiği sonucuna varılmıştır.

The crime phenomenon from the past to the present has existed in all human societics and will continue to exist in the future. This phenomenon, which lives with human communities, has recently entered the field of interest of economics and has begun to be examined with its economic dimension. In this study, first of all, the concept of crime was examined. Then, the concept of economic crime is mentioned and some types of economic crime are explained. While explaining the concept of economic crime, the definition of economic crime was made at first and then the history of economic crime; the world in general, the Ottoman Empire and the Republic of Turkey were discussed within the framework of dimensions. By referring to the economic models of crime and the crime market in economic models of crime, the relationship between crime and economy is explained.Some types of economic crimes were defined and their definitions in the TCK were included. İn the last part, the data obtained as a result of the survey conducted with 192 people working in the Elazig Courthouse and the annexed courthouses of the Elazig Courthouse were examined in order to evaluate the perception of the penalties given toeconomic crimes. As a result of the survey study, it was concluded that it is important for the society to work on improving the fight against economic crimes, eliminating deficiencies and reducing crime rates.
