HIRSIZLIK SUÇU İŞLEYEN ÇOCUKLAR ÜZERİNE SOSYOLOJİK BİR ÇALIŞMA: (BİTLİS İLİ ÖRNEĞİ)

Abstract

Sosyal problem olarak suç ve suçluluk, dinamik yapıda bulunması nedeniyle toplumdan topluma değişmektedir. Suç aktörleri incelendiğinde yetişkinlerin suç işlemesi bir problemdir ancak çocuk gibi masum bir varlığın suç işlemesi daha önemli bir problemdir. Bu bağlamda bir çocuk, kendini suç işlemeye yöneltecek herhangi bir unsurun varlığında suç işleyebilmektedir. Çocukları suça sürükleyen etkenler bireysel (ergenlik, depresyon, yetersiz öz denetim vb.) çevresel (okul, iş, akran- arkadaş etkisi vb.), sosyal (aile, göç ve alt kültür vb.) ve ekonomik (işsizlik, yoksulluk vb.) olarak ifade edilebilir. Çocukların suç işleme nedenleri kadar işledikleri suç türleri de önem arz eden bir konudur. Adalet Bakanlığı tarafından ilan edilen adli istatistiklerde çocukların genel olarak mala karşı suçları işlediği tespit edilmiştir. Bu yüksek lisans tezinde malvarlığına karşı suçlardan hırsızlık suçunu işleyen çocuklar ele alınmaktadır. Bu kapsamda Bitlis İl'i ve İlçelerinde ikamet eden ve 1 Ocak 2017-31 Aralık 2017 tarihleri arasında hırsızlık suçunu işleyen çocuklara ait sosyal inceleme raporları incelenmiştir. Çocuklara ait elde edilen veriler tablolara aktarılmış ve sosyolojik bakış açısıyla yorumlanmaya çalışılmıştır. Bu çalışma ile Bitlis ilinde çocukların hırsızlık suçunu işlemesinde aile ve arkadaş kaynaklı etkenlerin baskın olduğu, çocukların genellikle eğitimlerine devam etmediği ve bahse konu olan bu çocukların suçu işlemelerini önlemeye yönelik etkin bir çalışma bulunmadığı saptanmıştır.

When crime actors are examined, it is a problem for adults to commit a crime, but it is more important for an innocent entity such as a child to commit a crime. In this context, a child can commit a crime in the presence of any element that will direct him to commit a crime. Factors driving children to crime are individual (adolescence, depression, inadequate self-control, etc.) environmental (school, work, peer-friend influence, etc.), social (family, migration and subculture, etc.) and economic (unemployment, poverty, etc.). can be expressed as. The types of crimes committed by children are as important as the reasons for committing crimes. In the judicial statistics announced by the Ministry of Justice, it has been determined that children generally commit crimes against property. In this master's thesis, the children who commit theft for crimes against their assets are discussed. In this context, the social investigation reports of the children who live in Bitlis and the districts and committed the crime of theft between 1 January 2017-31 December 2017 were examined. The data obtained from children were transferred to tables and tried to be interpreted from a sociological perspective. In this study, it was determined that family and friend factors predominate in the crime of theft of children in Bitlis province, children generally do not continue their education and there is no effective study to prevent these children from committing the crime.
