MEHMED ZİHNİ EFENDİ'NİN Nİ'MET-İ İSLÂM ADLI ESERİNİN TALÂK BÖLÜMÜ İLE HUKUK-I AİLE KARARNÂMESİNİN TALÂK BÖLÜMÜNÜN MUKAYESESİ

Abstract

Mehmet Zihni Efendi, Osmanlı'nın son döneminde yaşamış, İslâm hukuku, Arapça, İslâm tarihi, hadis, akâid, tasavvuf gibi İslâmî ilimlerin birçoğunda eser telif etmiş olan bir Osmanlı âlimidir. Müellifin Ni'met-i İslâm adlı eseri, Türkiye'deki ilmihallerin kaynağını oluşturmaktadır. Diğer ilmihallerde olmayan evlilik ve boşanma konularını da içermesi açısından önem arz etmektedir. Eser Hanefî görüşlerini eas almaktadır. Osmanlı Hukuk-ı Aile Kararnâmesi de Ni'met-i İslâm ile aynı dönemde hazırlanmış bir kanun metnidir. Hanefî mezhebine göre yazılmasına rağmen bazen Hanefî uygulamasından ayrılarak, diğer mezheplerin görüşlerini kabul etmiş, bazı konularda kendine has tercihlerde bulunmuştur. Birçok İslâm ülkesinin de aile hukukuna etki etmiş ve bazı ülkelerde yakın zamana kadar uygulanmıştır. Bu iki eserin aile hukuku alanında önem arz eden, hassas bir mevzu olan ve günümüzde de ciddi bir problem olan talâk hususunda ortaya koymuş olduğu esasları, incelemek, karşılaştırmak ve çıkarımlarda bulunmak fayda sağlayacaktır. Mehmet Zihni Efendi is an Ottoman jurist who lived in the last period of the Ottoman Empire and wrote in many Islamic sciences such as Islamic law, Arabic, history, hadith, akaid and sufism.The author's work named Ni'met-i İslâm constitute the source of the catechisms in Turkey. It is also important in that it includes the issues of marriage and divorce which are not included in other catechisms. The work was written according to Hanafi views. The Ottoman law of family rights is also a text of the law prepared during the same period with Ni'met-i İslâm. Although it was written according to Hanafi sect it sometimes left the practice of Hanafi and accepted the opinions of the other sects and made individual choices in some subjects. It has influenced the family law of many İslâmic countries and in some countries has been applied until recently. It will be useful to examine and compare make inferences the principles of these two works about divorce which is important, a sensitive issue and a serious problem in field the family law today.
