MÂİDE SURESİ ÇERÇEVESİNDE İNSAN HAYATININ KORUNMASI

Abstract

İnsan hayatının hem madden hem de manen korunması insanın beslenmesi, yaşadığı ortamın güvenliği ve saldırı karşısında cânilerin cezalandırılmasının birlikte gerçekleşmesiyle mümkündür. Mâide Suresi?nde bunların hepsi de işlenmiştir. İnsan hayatının korunması için yeme içmenin çerçevesi belirlenmiş. Maide Suresinde ehli kitabın kadınları ve yiyecekleri de helal kılınıp bunun sınırlarının çizilmiş olduğunu görekteyiz.Mâide Suresi, insan hayatının devamı için evrensel kurallar koymuştur. Bu kurallar zaman üstüdürler. İnsanlığın ilk yaratıldığı günde esfeli safiline düşmesine sebep olan hastalıklarla, son dinin tamamlanması esnasında düşmesine sebep olan hastalıklar aynıdır. Mesela hased, kendini ayrıcalıklı görmek, günahta yardımlaşmak gibi hastalıklar bunun örnekleridir. Aynı şekilde insanın yükselmesine sebep olan kurallar da aynıdır. Bunlar da takva, iyilikte yardımlaşma, Allah için adaleti tesis etmek gibi kurallardır. Bu yüzden insan hayatı genel kurallar etrafında incelenmiştir.Suçların önlenebilmesi için suçluların gerekli şekilde cezalandırılması gerekir. Cezaların caydırıcı olmakla birlikte uygulanırken adaletli bir şekilde uygulanması gerekir. Mâide Suresi?ndeki hadd cezaları, şahsa göre değişmeyen, tamamen suçu yok etmeyi hedefleyen cezalardır. The protection of human life, both materially and spiritually human nutrition, living environment and safety in the face of attack is possible the realization of the punishment of the murderers. All of them processed in the Surat al-Maida and also frame for the protection of human life, eating and drinking. For the continuation of human existence, are the women and the food from people of the scripture lawful and the boundaries are drawn.The Surat al-Maide revealed universal rules for the continuation of human life. These rules are the parent of the time. From the first creating of the humanity till jet, was lot of diseases, which makes the spiritual position of human down. It?s the same diseases in the upon completion of last religion. For example, envy, self-privileged to see, such as sin cooperate diseases are examples of this. Also is the lead to an increase in the same way as rules that human beings are the same. These are taqva, helping in good things, justice for Allah. Therefore, to examine around the general rules can be more accurately. In order to prevent crimes, offenders should be punished accordingly. Punishment should be a deterrent. To be deterrent isn?t enough. It is also fair to be applied. The penalties which is described in the Surat al?Maide are so unchanging, that aim to eliminate completely the crime penalties.
