Abstract

Bu tezin konusu, İslam hukukunda boşama tasarrufunun şarta bağlanmsına dair hükümlerin tespitidir. Bu konu, özellikle boşanmaların arttığı ve yaygınlaştığı asrımızda önemlidir. Tezimiz bir giriş ve iki ana bölümden oluşmaktadır. Giriş bölümünde çalışmanın konusu amaçları kaynakları ve problem durumu ile ilgili bilgi verilmiştir. Birinci bölümde talak hükümlerine dair genel bilgiler tespit edilerek değerlendirilmiştir. İkinci bölümde ise klasik ve modern çalışmalardan istifade edilerek, talakı talikin çeşitleri ve neticeleri ele alınmıştır. Çalışmada prensip olarak dört sünni mezhep çerçevesinde kalmakla beraber az da olsa yürürülükte olan dört sünni mezhebin dışına da çıkılmıştır. Çalışmada, tercihe şayan görüşe ulaşabilmek için alimlerin görüş ve delilleri sunulurken tahlil yöntemi kullanılmıştır.

The subject of this thesis is the rulings on suspending divorce in Islamic jurisprudence which is significant especially nowadays ; Because this type of divorce has been pervasive and common in this era. The thesis consists of an introductory chapter and two main chapters. In the introductory chapter, general information about the research topic including its objectives, sources and problems. The provisions of divorce is discussed generally .In the second chapter, the suspension of divorce, its types, the results of the suspension and taking advantage of the old and modern considered books of jurisprudence are showcased in detail . In principle, the research did not leave the circle of the four Sunni schools of thought, but it rarely referred to the opinions opposing the four prevailing schools of thought It has taken the comparative analytical method by presenting the opinions of scholars and their evidence to reach the most correct opinion. Arab personal status laws, which say that suspended divorce does not occur, have taken care of the cohesion of families and to preserve them from disintegration.
