HANEFÎ MEZHEBİNE GÖRE İBADETLER ÖZELİNDEKİ FURÛK-I FIKHİYYE

Abstract

Furûk; tefsir, Arap dili, kelâm gibi ilimlerin yanı sıra fıkıh ilminin de alt dalı olarak gelişme göstermiştir. Fıkıh literatüründe şeklen benzediği halde hüküm bakımından farklı olan meselelerin incelendiği alan bu isimle anılmaktadır. Bu ilim dalı füru fıkıh eserlerindeki meselelerin benzer ve farklı yönlerinin incelenmeye başlanmasıyla birlikte gelişme göstermiş hicri 4. asırda ilk müstakil eserler kaleme alınmıştır. Eşbâh ve nezâir türü eserler içerisinde genellikle müstakil bir bölüm olarak furûk bulunmaktadır. Bu bölümlerde fürû fıkhın sistematiği içerisinde furûk örneklerine yer verilmektedir. Diğer yandan usûl eserlerindeki konuların benzerlik ve farklılıklarının ele alındığı eserler de bu isimle anılmaktadır. Klasik fıkıh eserlerindeki içtihatlar arasındaki cem' ve fark noktalarının tespit ve tahlili hâlâ güncelliğini korumakta olup bu alanla ilgili birçok araştırma yapılmaktadır. Bu tezde Hanefî fakîhlerin ibadetlerle ilgili içtihatları furûk yazım yöntemlerinden biri olan fürû metodu kullanılarak tespit ve tahlil edildi. Klasik Hanefî kaynakları doküman analizi yöntemiyle değerlendirildi. Birinci bölümde fıkıh ilminin alt disiplini olarak furûk incelendi. İkinci bölümde taharet, namaz, oruç, zekât ve hac başlıkları altında şeklen benzediği halde hüküm bakımından farklı olan meseleler delilleriyle ele alındı. Bu tezin temel amacı benzer fıkhî meselelerin neden farklı hükümler aldığını tespit etmektir. Sonuç olarak furûkun genellikle içtihadi konularda mevcut olduğu görüldü.

Fur?q has developed as a sub-branch of fiqh as well as sciences such as tafsir, Arabic language, and theology. In the fiqh literature, the field in which the issues that are similar in form but different in terms of judgement are analyzed is known by this name. This branch of science developed with the beginning of analyzing the similar and different aspects of the issues in the works of fiqh and the first independent works were written in the 4th century of Hijri. There is usually a separate chapter on fur?q in the works of the genre of al-ashb?? and al-na??ir. These chapters include examples of fur?q within the systematics of fur? fiqh. On the other hand, the works that deal with the similarities and differences of the subjects in the works of us?l are also referred to by this name. The identification and analysis of the points of convergence and difference between the jurisprudence in classical fiqh works is still up to date and many studies have been conducted in this field. In this thesis, the ijtih?ds of Hanafi jurists on acts of worship were identified and analyzed by using the method of jurisprudence, which is one of the methods of writing fur?q. Classical Hanafi sources were evaluated by document analysis method. In the first chapter, fur?q was examined as a sub-discipline of fiqh. In the second chapter, issues that are similar in form but different in terms of judgement under the headings of taharah, prayer, fasting, zakat and pilgrimage were discussed with their evidence. The main purpose of this thesis is to determine why similar fiqh issues have different judgements. As a result, it was seen that fur?q is generally existing in jurisprudential matters
