PATENT TİCARİLEŞMESİNDE TÜRKİYE İÇİN ÇALIŞABİLEN BİR MODEL

Abstract

Fikri mülkiyet hakları, günümüzde toplumların en değerli hazinelerini barındıran haklardır. Zenginliğin ölçüsünün bilgiye dönüştüğü günümüzde, sanatsal ve bilimsel birikim arşivi niteliğinde olan bu haklar, hakkın konusu olan değerlerin etkili bir şekilde korunmasını sağlar. Patent hakkı, insanlığın bilimsel ve teknolojik birikiminin izlenebildiği, gelecek kuşaklara aktarıldığı patent sistemlerinin işleyişinin bağlı olduğu haktır. Ülkeler yeni buluşlar için patent hakkı olanağı tanıyarak hem buluş faaliyetlerini hem de buluşların açıklanmasını özendirirler. Böylece buluş döngüsünün de hızlanması sağlanır. Günümüzde şirketlerin değeri, fiziki varlıklardan çok sahip oldukları sınai ve fikri sermayeyle ölçülmektedir. Bu nedenle bir şirketin değeri sahip olduğu patentlerle daha çok artmaktadır. Patent ticarileşmesi ile patentin değeri daha çok artmaktadır. Bu çalışmada patent ticarileşmesinde yer alan patent değerleme, patent lisans sözleşmeleri, ticarileşmeyi sağlayan arayüzler ile ilgili Türkiye'de yapılan çalışmalarda literatür taraması yaparak belirlenen sorun ve çözüm önerilerini bir araya getirerek Türkiye'de patent ticarileşmesi için bir yol haritası belirlemektir. Bölgesel olarak yapılan patent olgunluk ölçümünün BRL Ölçeğinde değerlendirilmesi ise Türkiye'de patent ticarileşmesi için çalışılabilen bir model olarak geliştirilebilir.

Intellectual property rights are the rights that contain the most valuable treasures of societies today. Today, when the measure of wealth turns into knowledge, these rights, which are an archive of artistic and scientific knowledge, ensure the effective protection of the values that are the subject of the right. The patent right is the right that depends on the functioning of the patent systems on which the scientific and technological accumulation of humanity can be followed and transferred to future generations. Countries encourage both invention activities and disclosure of inventions by providing patent rights for new inventions. Thus, the innovation cycle is accelerated. Today, the value of companies is measured by their industrial and intellectual capital rather than their physical assets. Therefore, the value of a company increases more with the patents it holds. With patent commercialization, the value of the patent increases even more. In this study, it is aimed to determine a roadmap for patent commercialization in Turkey by bringing together the problems and solution proposals determined by literature review in the studies conducted in Turkey on patent valuation, patent license agreements, interfaces that enable commercialization. The evaluation of the regional patent maturity measurement on the BRL Scale can be developed as a workable model for patent commercialization in Türkiye.
