ŞÂFİÎ FAKİH EL-BEGAVÎ VE FIKIHÇILIĞI

Abstract

Selçuklu Devleti dönemi âlimlerinden, Begavî olarak tanınan Ebû Muhammed Hüseyin b. Mesûd b. Muhammed b. Ferrâ el-Begavî; tefsir, hadis, fıkıh ve kırâat gibi farklı alanlarda eserler telif edip tefsir, hadis ve kırâat alanındaki ilmî yetkinliği ile tanınmaktadır. Ancak fıkıh alanındaki konumu ileri düzeyde olmasına rağmen diğer alanlardaki kadar, özellikle akademik çevrede, yeterince bilinmemektedir. Begavî, İslâm hukukunun iki temel kaynağı olan Kitap ve sünnet hakkında eserler telif ettikten sonra fıkıh alanında et-Tehzîb fî fıkhi'l-İmâmi'ş-Şâfiî isimli eserini kaleme almıştır. Fıkhî görüşleri Şâfiî doktrini çerçevesinde şekillenen Begavî, zaman zaman Şâfiî mezhebine muhalefet etmiştir. Bu çalışmada akademik alanda yeteri kadar bilinmeyen Begavî'nin fıkıhçılığının ortaya konulması amaçlanmıştır. Çalışma, giriş ve üç bölümden oluşmaktadır. Giriş bölümünde çalışmanın amacı, önemi, yöntemi ve kaynakları hakkında teknik bilgiler verilmiştir. Birinci bölümde Begavî'nin hayatı, ilmî kişiliği ve ilmî kişiliğinin tarihi arka planı ele alınmıştır. İkinci bölümde Begavî'nin usûlî görüşleri incelenmiştir. Üçüncü bölümde ise Begavî'nin fıkhî görüşleri, Şâfiî mezhebindeki yeri ve ona yapılan eleştiriler tespit edilerek değerlendirilmiştir.

Known as Begavî among the scholars of the Seljukid period, Ebû Muhammed Hüseyin b. Mesûd b. Muhammed b. Ferrâ el-Begavî; is recognized for his works in various fields such as interpretation, hadith, jurisprudence, and recitation, and for his scholarly competence in interpretation, hadith, and recitation. However, despite his advanced position in jurisprudence, he is not as well-known, especially in the academic field, as in other areas. After writing works on the two fundamental sources of Islamic law, the Quran and the Sunnah, Begavî penned his work titled "et-Tehzîb fî fikhil-İmâmi'ş-Şâfiî" in the field of jurisprudence. Shaped by Shafiî doctrine, Begavî's jurisprudential views occasionally diverged from the Shafiî sect and naturally opposed to the other sects as well. This study aims to show Begavî's jurisprudence, which is insufficiently known in the academic field. Our study consists of an introduction and three chapters. The introduction provides technical information about the purpose, significance, methodology, and sources of our study. The first chapter discusses Begavî's life, scholarly persona, and the historical background of his scholarly persona. In the second chapter, Begavî's procedural opinions are mentioned. In the third chapter Begavî's juristic views, his place in the Shafiî sect, and criticisms made against him are identified and given.
