dc.description.abstractGeçmişten günümüze tüm topluluklarda insanlar sözü kuvvetlendirmek, gerçeği beyan etmek ve muhatabını ikna etmek amacıyla yemin ifadelerine başvurmuştur. Günümüzdeki gibi işleyen bir hukuk sisteminin olmadığı geçmiş dönemlerde Tanrı veya toplumda kutsal kabul edilen varlıklar üzerine yapılan yeminler hukuki ve ahlaki açıdan düzenleyici bir işlev görmüş ve bu nedenle insan topluluklarının huzur içerisinde yaşamasında hayati bir rol oynamıştır. Pek çok dini gelenekte olduğu gibi, ilahi dinlerden olan Yahudilikte de yemin kavramı önemli bir yer tutmuştur. Dinin temel yapısını oluşturan "ahit" kavramı aynı zamanda yemin olgusunun da çerçevesini oluşturmaktadır. Tora'nın ilk pasuklarından itibaren kullanılan yemin ifadeleri tanrısal ahit ile başlayıp, peygamberler ve insanlar arasındaki yeminler ile devam etmektedir. Tevrat'ın yemin yasaları; Tanrı yeminleri ve antlaşma kapsamındaki yeminler, Tanrı adına yapılan yeminler, gönüllü yeminler ile taahhüt kapsamındaki yeminler, masumiyeti ispat ve tanıklık yeminleri, yalan yere yapılan yeminler ile boş ve gereksiz yeminleri kapsamaktadır. Bu tez çalışmasının giriş başlığında araştırmanın konusu, amacı, önemi, kapsam ve sınırlılıkları ile yöntemi verilerek, yararlanılan kaynaklardan bahsedilmiştir. İkinci başlıkta yemin kavramına değinilerek, çeşitli dinlerde yemin konusundaki yaklaşım ele alınmıştır. Üçüncü başlıkta Yahudilik hakkında genel bilgi verilerek Yahudilikte yemin olgusunun yeri ve Tevrat'taki yemin türleri incelenmiştir. Dördüncü başlıkta Yahudilikte yeminlerin sosyal ve etik boyutu, beşinci başlıkta yeminlerin ihlalleri ve sonuçları Tevrat pasuklarından hareketle ortaya konulmuştur. dc.description.abstractThroughout history, people in all societies have resorted to oaths to strengthen their words, declare the truth, and persuade their interlocutors. In past eras, when legal systems did not function as they do today, oaths sworn in the name of God or beings considered sacred in society served a regulatory function in legal and moral terms, and therefore played a ital role in ensuring peaceful coexistence among human communities. As in many religious traditions, the concept of oaths holds an important place in Judaism, one of the Abrahamic religions. The concept of "covenant" which forms the basic structure of religion, also frames the phenomenon of oaths. The oaths used in the Torah, starting from its earliest verses, begin with the divine coenant and continue with oaths between prophets and people. The laws regarding oaths in the Torah encompass oaths to God and covenant oaths, oaths made in the name of God, voluntary oaths and pledges, oaths of innocence and testimony, perjury, and empty and frivolous oaths. The introduction to this thesis outlines the subject, purpose, significance, scope, limitations, and methodology of the research, as well as a list of sources used. The second section addresses the concept of oaths, examining the approach to oaths in various religions. The third section provides general information about Judaism, examining the place of oaths in Judaism and the types of oaths in the Torah. The fourth section examines the social and ethical dimensions of oaths in Judaism, while the fifth section discusses the violations of oaths and their consequences, drawing on verses from the Torah.
